$200k Bail for Donald Trump in GA, Will Surrender Thursday

Donald Trump's Atlanta's lawyers were at the courthouse in Atlanta Monday hammering out a bond agreement with prosecutors in his election interference case. This is the case where he and 18 others, including Rudy Giuliani (I smile every time I type the words "defendant Rudy Giuliani") are charged with violations of Georgia's version of the federal organized crime statute known as "RICO".

Here's the final bond order , signed by the Judge.

The $200,000. is no big deal since Trump can elect to pay just 10% of it. And the Secret Service may well prevail over jailers at the Fulton County Jail as to whether Trump has to be mug-shotted and booked just like ordinary defendants. rules for ordinary defendants and refuse to allow him from being booked at the infamous, filthy, violent Fulton County jail, which just last month was notified by the DOJ's that the agency's civil rights division has placed the jail under investigation over its filthy conditions and abhorrent treatment of inmates, including the mentally ill.

The "non-financial conditions" of the bond order are what puts the zing to the court's order. The full 3 page order is here. [More...]

Trump is not allowed to threaten or intimidate any co-defendant, any of the 30 unindicted co-conspirators or witnesses in the case. On social media or by reposting other's tweets on social media. He can't obstruct justice. He also can't make any “direct or indirect threat of any nature against the community or to any property in the community.” (That last one about the community is a little vague. For example, does the community include the prosecutor who has Trump frothing at the bit, calling her crooked, since it's her job to to represent the people of Atlanta?) Does it include his making fact-free claims about Atlanta's murder rate sky-rocketing when in fact its' gone down?

The prohibition includes both posting on social media and reposts of others' posts. He also can't communicate with co-defendants about the case, except through their respective lawyers.

Trump announced on his truth and social site he will turn himself in at the Fulton County Jail in Atlanta on Thursday.

In other current Trump mishaps, Don, Jr. announced today on a right-wing newsite that he and fiancée Kimberly Guilfoyle will attend the Wisconsin Republican debate as Trump's media surrogates. (Trump, as everyone knows, is not participating in the debate).

The " mishap" is that according to the New York Post, Fox News announced few hours later no surrogates would be allowed at the Wisconsin debate. So Don and Kimberly are now making a last ditch effort to be allowed in the pundit's post-debate spin room.

Members of Trump’s campaign team and the former president’s surrogates will still travel to Milwaukee amid the banishment and are working on a resolution with Fox News and the Republican National Committee in order to be allowed in the post-debate “spin room,” according to the report.

I'd say the least of Donald Trump's problems is whether he or a surrogate attend a Republican debate. Complying with his bond conditions is going to be his greatest challenge yet. After that? Unless he gets the Georgia and New York indictments moved to federal court and wins the 2024 election, after which his new Attorney General will dismiss all charges in all four federal jurisidictions, I think he's doomed.

Any defendant with a private plane (or boat capable of getting from Florida to an independent Caribbean island) would have his passport seized as a condition of bail, as well as a requirement to advise a pretrial release officer (like a probation officer for people on bail) and get permission (48 hrs in advance or something like that) for all domestic travel, even assuming travel was not restricted to Georgia and Florida (and perhaps NJ-NY). And if that defendant started musing on social media about how others imagine he will flee to "Russia, Russia, Russia" he would have to appear in person to persuade the judge that those were not his own thoughts.

The federal removal statute for civil cases (5.00 / 1) (#20)
by Peter G on Tue Aug 22, 2023 at 07:51:02 PM EST
provides for an automatic stay of state court proceedings upon the filing of the defendant's notice of removal. The criminal removal statute (the one involved here) does not provide for an automatic stay, only a stay if and after the federal judge finds that the case apparently qualifies for removal, which may require a hearing first. The difference in wording is stark, reflecting how unlikely it is for the removal of a criminal case to be approved. As a result, in a criminal case a stay basically cannot happen in two or three days. So Meadows's new motion is just a stunt.

After GOP debate showing, Vivek Ramaswamy sees his crowds growing in central Iowa

Yet on Friday morning, throngs of Iowans packed Ramaswamy's appearances.

Iowa State Senate President Jake Chapman, Ramaswamy's Iowa co-chair, said they planned for 75 to 100 people to attend an event at Fireside Bistro in Indianola Friday morning. Instead, 300 people showed up, he estimated.
